What you need to know
What grounds can I use to set aside a CCJ?
Common grounds include: you were not served the claim properly, you have a genuine defence to the original debt, the amount was wrong, or the claimant did not follow correct procedure.
How long do I have?
If you apply within 30 days of judgment the court should set it aside. After 30 days you need stronger grounds. There is no absolute time limit but acting sooner is always better.
Will this affect my credit file?
Once a CCJ is set aside it is removed from the Register of Judgments and from your credit file — usually within 28 days.
